Attorney General Becerra Files Reply to Trump Administration in National Emergency Lawsuit

SACRAMENTO – California Attorney General Xavier Becerra today, leading a 20-state coalition, filed a reply brief in the Northern District of California in the 20-state lawsuit, California et. al. v Trump, et al., challenging President Trump's unlawful national emergency. On March 21, the state coalition filed a motion for preliminary injunction to stop President Trump from illegally diverting funding for a border wall.

“President Trump’s power is not unlimited,” said Attorney General Becerra. “Congress, which holds the power of the purse, has twice rejected the President’s proposals to fund a border wall. The President’s maneuver to divert taxpayer dollars meant to support Americans in their communities violates the Constitution and risks critical services reaching hardworking taxpayers and their families. Today, we filed our response to the Administration’s dishonest defense of its illegal actions. We have been joined in this fight by over 100 bipartisan former members of Congress representing 36 states. No one is above the law."
