PROVIGIL® Settlement Distribution Updates

September 24, 2019 Update: On August 8, 2019, the Court approved the State of California’s Motion for Preliminary Approval of the Settlement and the corresponding notice plan to consumers and proposed Claim Form. The 2019 Order permitted consumers to submit claims to the settlement through January 15, 2020.

Consumers are eligible to make a claim if they:

  • Purchased and/or paid for Provigil®, Nuvigil®, and/or generic versions of Provigil® (modafinil),
  • Were a resident of California at the time each purchase was made,
  • Purchased by you as a caregiver or for your personal consumption, and
  • Purchased between June 24, 2006 and December 31, 2012.

You are eligible even if your purchase was reimbursed fully or partially by insurance.

Consumers who believe that they are eligible to submit a claim should check the court-approved settlement website, www.ProvigilSettlement.com to obtain the official notice and claims forms.

The details of the Attorney General’s Settlement and the realted multistate Class Action Settlement can be found at www.ProvigilSettlement.com. Critical dates are posted and updated on the settlement website. The claim form may be completed online for both settlements or may be submitted by mail.

October 14, 2022 Update: On October 11, 2022, the Court granted the State of California’s Motion for Disbursement of Funds and permitted direct cash payments to be made to 6,169 Claimants with validated Claim Forms. The 2022 Order also permits Late Claims to be filed by potential Eligible Consumers who have not yet submitted a Claim Form in this action. The deadline for submitting a Late Claim Form is January 9, 2023.

November 9, 2022 Update: The Court-appointed Settlement Administrator is in the process of preparing direct cash payments to the 6,169 Claimants with validated Claim Forms. Each Claimant’s share of the Provigil Settlement will be calculated based on the Court-approved rate of $32.01 per prescription. The target date for delivery of the payment checks by the United States Postal Service is before Thanksgiving Day or shortly thereafter.

November 15, 2022 Update: Distribution checks have been mailed by the Court-appointed Settlement Administrator.

September 15, 2023 Deadline on Reissued Checks/Unclaimed Funds: Claimants who have received reissued checks and have not cashed them as of the check void date may contact the Court-appointed Settlement Administrator to request another reissue. Please submit your request before September 15, 2023. Below is the contact information:
