Antitrust Complaint Form

The antitrust laws protect fair competition by prohibiting unfair and anti-competitive business practices. Vigorous enforcement of the antitrust laws helps consumers, employees, and businesses alike. By fostering a level playing field, the antitrust laws encourage innovation and allow new companies and ideas to flourish. Consumers benefit from increased price competition, more product variety, and better services. And in a competitive labor market, employees have access to increased job mobility and higher wages.

In general, antitrust violations fall into three categories:

  • Collusion:

    The antitrust laws prohibit collusion, or when competitors enter into agreements to reduce competition and gain an unfair advantage in the marketplace. These agreements include price fixing (an agreement to raise, lower, or maintain prices), market allocation, (an agreement to stay out of each other’s territories), limiting or reducing production, and bid rigging (tampering with a competitive bidding process). This also includes agreements where competing employers agree to keep employee wages down, or when competitors agree to stop trying to hire employees from each other.

  • Anticompetitive Mergers or Acquisitions:

    The antitrust laws are potentially violated when there is a merger between companies that previously competed with each other, or when there is a merger that makes it harder for other companies to compete.

  • Monopoly Abuse:

    The antitrust laws also prohibit monopoly abuse, or when a dominant company uses its size to make it harder for other companies to compete. This includes making it harder for competitors to access customers, supplies, or labor. This also includes situations where, if you want to buy a product from a company, the company forces you to buy another product along with the desired product.

The Antitrust Complaint Form is for individuals and businesses in California who wish to report anticompetitive conduct that potentially violates the antitrust laws. Attorneys in the Antitrust Law Section will use the information provided to identify potential antitrust violations and potentially pursue further legal action.
