This settlement introduces new language into Section 8 to clarify the enforcement mechanism. The section now states: "In any action by either Party to enforce the terms of this Consent Judgment, the prevailing party shall be entitled to its reasonable attorneys’ fees and costs. With respect to any third-party enforcement action, nothing in this Consent Judgment shall preclude a public agency prosecutor from seeking to enforce the settlement under Cal. Health & Safety Code § 25249.7(c), nor shall any private party prosecutors acting “in the public interest” be precluded by this Consent Judgment from seeking to enforce the settlement under Cal. Health & Safety Code § 25249.7(c)."
