Defendants shall be permanently enjoined from manufacturing for sale in California, directly selling to a consumer in California, or distributing into California, any of the Covered Products that are manufactured after the Effective Date without first providing a clear and reasonable warning. The warning shall be prominently affixed to or printed upon the label of the Covered Products, as compared with other statements or designs on the label, as to render it likely to be read and understood by an ordinary purchaser or user of the product, in conformity with OEHHA regulations in effect at the time this Consent Judgment is executed. In addition Defendants agree to provide, on the product label, instructions or other documents or packaging accompanying the test kits that are manufactured after the Effective Date that will be sold in California, language instructing the user not to let skin or clothes come into contact with the pool test kit solution and that the cap must always be used with the test kit vial and not to cover the test kit vial with fingers during use.
