3.3. AnyCoveredProductsthatDefendantDistributesintotheStateofCaliforniaafterthe
EffectiveDate,shalleither(1)complywiththewarningrequirementsofSection3.4or(2)
musthaveNon-DetecttestresultsfortheListedChemicalpursuanttotherequirementsof
Section3.5.

$ 43,500.00 ($43,500.00 shall be distributed to Plaintiff as an
AdditionalSettlementPayment(“ASP”),pursuanttoCaliforniaCodeofRegulations,title
11,sections3203,subdivision(d)and3204.Plaintiffwillusethispaymentasfollows:
Eightypercent(80%)forfeesofinvestigation,purchasingandtestingforProposition65
listedchemicalsinvariousproducts,andforexpertfeesforevaluatingexposuresthrough various mediums, including but not limited to consumer product, occupational, and
environmental exposures to Proposition 65 listed chemicals, and the cost of hiring
consulting and retaining experts who assist with the extensive scientific analysis
necessaryforthosefilesinlitigationandtooffsetthecostsoffuturelitigationenforcing
Proposition65butexcludingattorneyfees;forpublishingperiodicalsandothermedias
regardingpublicawarenessabouttheissueofenvironmentalpollutionandpresenceof
Proposition 65 chemicals in the environment and consumer products; donations and
supplies,includingbutnotlimitedto,waterfiltersandairfiltersforpublicschoolsand
communities,toregionsimpoverishedbyindustrialpollution.Andtwentypercent(20%)
foradministrativecostsincurredduringinvestigationandlitigationtoreducethepublic’s
exposuretoProposition65listed chemicalsbynotifyingthosepersons and/orentities
believedtoberesponsibleforsuchexposuresandattemptingtopersuadethosepersons
and/or entities to reformulate their products or the source of exposure to completely
eliminateorlowerthelevelofProposition65listedchemicalsincludingbutnotlimited
to costs of documentation and tracking of products investigated, storage of products,
website enhancement and maintenance, computer and software maintenance,
investigative equipment, Plaintiff’s member’s time for work done on investigations,
officesupplies,mailingsupplies,service,andpostage.Within30daysofarequestfrom
the Attorney General, Plaintiff shall provide to the Attorney General copies of
documentationdemonstratinghowtheabovefundshavebeenspent.Plaintiffshallbe
solely responsible for ensuring the proper expenditure of such additional settlement
payment.)
