Commencing on the effective date of the settlement agreement, the defendant agrees to only sell or offer for sale or purchase for sale in or into California, Covered Products which are “Reformulated Products.” For purposes of this Settlement Agreement, “Reformulated Products” shall mean Covered Products containing less than or equal to 1,000 parts per million (0.1%) DIDP or DINP in each accessible component and/or Products that contain a clear and reasonable Proposition 65 warning that complies with the relevant regulations.
