Excelsior Nutrition and Fresh Nutrition shall only ship, distribute, sell or offer for sale in California, Covered Products that are labeled with a clear and reasonable warning pursuant to Section 3.2. Excelsior Nutrition and Fresh Nutrition shall have no obligation to label Covered Products that were shipped or sold to third parties and are no longer in the possession of or under the control of Excelsior Nutrition or Fresh Nutrition prior to the Effective Date.
