The Fountain Park Apartments were build on top of one of the largest methane leaks in the Western United States. To mitigate the impacts of the methane, which also included BTEX gases and Hydrogen Sulfide, Playa Capital was required to comply with strict methane mitigation requirements. These requirements, which included active venting systems, emergency procedures when methane alarms were triggered, monthly reporting requirements and automatic notification of the fire department have not been complied with. The methane alarms are triggered at least once a month, and Essex Property (the property management company) has been informing tenants that the alarms are malfunctioning fire alarms. These are properly functioning methane alarms that are being triggered at 25% of the lower explosive limit of methane. During alarms, residents are being subjected to not only BTEX gases without notice, but also are not evacuating from a potentially hazardous and explosive environment
