The Registry of Charities and Fundraisers assigns entity, registration, and/or compliance statuses to entities reflected in the Registry Search Tool.
Entity Statuses
An entity status is assigned to each entity in the Registry Search Tool regardless of whether it is registered or not with the Registry of Charities and Fundraisers. An entity can only have one entity status.
- Listed: default status that indicates the entity is listed in the Registry Search Tool.
- Cease and Desist compliance status: Entity is subject to a final cease and desist order. (E.g., Gov. Code, § 12591.1, subd. (b); Cal. Code Regs., tit. 11, § 337.) The entity is not in good standing with the Registry. (Cal. Code Regs., tit. 11, § 312.)
- Dissolution Pending: Entity that is a California nonprofit corporation has submitted a request for approval of the corporation’s dissolution.
- Dissolution Waiver Issued: Entity that is a California nonprofit corporation has submitted a request for approval of the corporation’s dissolution, and the Registry has issued a waiver of objections to the dissolution plan.
- Dissolved: Entity that is a California nonprofit corporation has been dissolved by the California Secretary of State.
- Enforcement Action Pending: Entity is subject to an enforcement action filed by the California Department of Justice. No final judgment, decision, cease and desist or other order has been entered against the entity.
- Exempt: Entity has been determined to be exempt from the registration and reporting requirements of the Supervision of Trustees and Fundraisers for Charitable Purposes Act (Gov. Code, § 12580 et seq.).
- Exempt 990-PF: Entity that is a religious organization has been determined to be exempt from the registration and reporting requirements of the Supervision of Trustees and Fundraisers for Charitable Purposes Act (Gov. Code, § 12580 et seq.), but is required to submit IRS Form 990-PF and IRS Form 4720 (if applicable) to the Registry pursuant to Internal Revenue Code instructions.
- Merged Out: Entity has merged and was subsumed by another (surviving) entity pursuant to a merger transaction. A merged out entity no longer exists.
- Notice to Register: Entity has been issued a notification to register.
- Registration Not Required: Entity has been determined to be exempt from the registration and reporting requirements, as its scope of activities as represented to the Registry does not trigger the registration and reporting requirements of the Supervision of Trustees and Fundraisers for Charitable Purposes Act (Gov. Code, § 12580 et seq.).
- Terminated: Entity that is a trust has had its registration withdrawn because the trust has terminated or is in the process of terminating. A trust that has terminated no longer exists.
- Withdrawn: Entity that has had its registration withdrawn. This includes an entity that is a foreign charitable corporation or trust that represented to the Registry that it has ceased soliciting in California or ceased directing solicitations to California, ceased providing services or activities in or directed at California, and/or otherwise ceased conducting business in California; an unincorporated association that has dissolved; or an unincorporated association or other trustee that represented to the Registry that it has ceased soliciting and operating for charitable purposes, and holding charitable assets.
Registration Statuses
A registration status is assigned to each entity for each registration number it has or had with the Registry. Most entities have only one registration number and are registered for only one registration type, typically as a Charitable Organization (which includes charities, trusts, trustees, and platform charities). Some entities are registered for more than one registration type: Charitable Organization, Raffle, Commercial Fundraiser, Fundraising Counsel, Commercial Coventurer, and Charitable Fundraising Platform.
Entities registered as a Charitable Organization typically have a registration number that begins with CT, but for older registrants, the registration number does not begin with CT and is only numeric. The registration number for a Charitable Organization is also called a State Charity Registration Number.
A Raffle registration number begins with RF. Commercial Fundraiser, Fundraising Counsel and Commercial Coventurer registration numbers begin with FP, and Charitable Fundraising Platform registration numbers begin with PL.
- Registered: Indicates the entity is registered for a particular registration type. View the entity’s record in the Registry Search Tool to determine which registration type(s) apply.
- Delinquent: Entity with a delinquent Charitable Organization or Charitable Fundraising Platform registration, typically for failure to file complete annual reports and/or to pay late fees. (E.g., Gov. Code, §§ 12586, 12586.1, 12599.9, subd. (c).) The entity is not in good standing with the Registry (Cal. Code Regs., tit. 11, § 312.)
- Delinquent Platform Charity: Entity that is a platform charity with a delinquent Charitable Organization registration, for failure to file completed annual fundraising reports and/or to pay late fees. (E.g., Gov. Code, §§ 12586.1, 12599.9, subd. (c).) The entity is not in good standing with the Registry (Cal. Code Regs., tit. 11, § 312.)
- Expired: Entity with an expired Raffle, Commercial Fundraiser, Commercial Coventurer or Charitable Fundraising Platform registration, that is not registered for the current registration year. The entity is not in good standing with the Registry (Cal. Code Regs., tit. 11, § 312.)
- Not Registered: Entity that is not registered as a Charitable Organization, although it was previously registered.
- Not Registered Merged Out: Entity that is not registered, although it was previously registered. The previously registered entity has merged and was subsumed by another (surviving) entity pursuant to a merger transaction, and no longer exists.
- Not Registered Withdrawn: Entity that is not registered, although it was previously registered. The previously registered entity had its registration withdrawn.
- Pending Renewal: Entity with Charitable Fundraising Platform registration that has a registration renewal application being processed, or was registered for the prior registration year and has not timely filed a registration renewal application.
- Registered Exempt Reporting: Entity is a corporate trustee with a Charitable Organization registration that is exempt from filing annual reports.
- Revoked: Entity with a revoked registration for a particular registration type. (E.g., Gov. Code, § 12598, subd. (e)(1); Pen. Code, § 320.5, subd. (i), (j); Cal. Code Regs., tit. 11, §§ 339, 341, 419.2.) The entity is not in good standing with the Registry (Cal. Code Regs., tit. 11, § 312. See also §§ 345, 346.)
- Suspended: Entity with a suspended registration for a particular registration type. (E.g., Gov. Code, §§ 12591.1, subd. (d)(1), 12598, subd. (e)(1); Pen. Code, § 320.5, subd. (i), (j); Cal. Code Regs., tit. 11, §§ 339, 341, 344, 419.2.) The entity is not in good standing with the Registry (Cal. Code Regs., tit. 11, § 312. See also § 345, subds. (b) & (c).)
Compliance Statuses
A Compliance Status may be assigned to an entity’s registration to indicate compliance issues, if any. An entity can have more than one compliance status per registration.
- Adverse Action: Entity has provided notice, or has been the subject, of an adverse action. This includes an entity that has an officer, director, key employee, or owner that was the subject of an adverse action. (See Cal. Code Regs., tit. 11, §§ 339, subd. (g), 340, subd. (b).)
- Cease and Desist: Entity is subject to a final cease and desist order. (E.g., Gov. Code, § 12591.1, subd. (b); Cal. Code Regs., tit. 11, § 337.) The entity is not in good standing with the Registry. (Cal. Code Regs., tit. 11, § 312.)
- Corporate Trustee: Entity has been determined to be a corporate trustee, and thus does not need to comply with annual reporting requirements.
- Enforcement Action: Entity is subject to an enforcement action filed by the California Department of Justice. No final judgment, decision, cease and desist or other order has been entered against the entity.
- Fine/Penalty Due: Entity is subject to a final assessment of fines or penalties. (Gov. Code, § 12591.1, subds. (a), (c); Cal. Code Regs., tit. 11, § 338.)
- Late Fee Due: Entity owes a late fee. (Gov. Code, § 12586.1.)
- No Bond: Entity with a Commercial Fundraiser registration that has not filed a current surety bond. (Gov. Code, § 12599.5.)
- Probation: Entity is subject to a probation stipulation or order. (See, e.g., Cal. Code Regs., tit. 11, § 346.)
- Probation Violation: Entity has been determined to violate a probation stipulation or order.
